Terms of Service

1. Acceptance of Terms

By accessing or using Atavus AI (atavus.ai) ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. We reserve the right to update these terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

Atavus AI provides a SaaS platform for creating, training, and deploying custom AI assistants. Users can define AI personality, connect data sources, embed assistants on websites, integrate via API, Telegram, and Discord, and manage subscriptions. The Platform is provided "as is" and "as available."

3. User Accounts

  • You must be 18+ to create an account
  • You are responsible for maintaining account security
  • You must provide accurate registration information
  • One person may hold only one free account
  • Sharing accounts is prohibited
  • Notify us immediately of unauthorized access

4. Subscriptions & Billing

  • Free Tier: Limited to 1 assistant, 1,000 messages/month, 50MB storage
  • Paid Tiers: Basic ($29/mo), Pro ($99/mo), Enterprise ($999/mo) as described on the billing page
  • Payments are processed securely via Stripe
  • Subscriptions auto-renew unless canceled
  • Cancel anytime — access continues until end of billing period
  • No refunds for partial months
  • Prices may change with 30 days notice

5. Acceptable Use

You agree NOT to:

  • Use the Platform for illegal activities or harassment
  • Create AI assistants that promote hate speech, violence, or discrimination
  • Attempt to reverse-engineer, hack, or disrupt the Platform
  • Use automated bots to abuse the API beyond fair rate limits
  • Upload malware, viruses, or malicious code
  • Impersonate other individuals or entities
  • Violate any applicable laws or regulations

6. Content & Data Ownership

  • You retain all ownership of content you create (assistant personalities, training data, conversations)
  • We claim no intellectual property rights over your content
  • You grant us a license to host, store, and process your content to provide the service
  • We do not train our models on your data or conversations
  • AI responses are generated algorithmically and may contain errors
  • You are responsible for the accuracy and legality of your content

7. Third-Party Services

The Platform integrates with third-party services including DeepSeek AI, Ollama, and Stripe. Your use of these services may be subject to their respective terms. We are not responsible for the availability, accuracy, or security of third-party services.

8. Limitation of Liability

To the maximum extent permitted by law, Atavus AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. The Platform may be temporarily unavailable for maintenance, upgrades, or due to circumstances beyond our control. Enterprise tier includes SLA guarantees as specified in the Enterprise agreement.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in prohibited use, or pose a security risk. Users may cancel their account at any time via Settings. Upon termination, your data will be deleted within 30 days.

11. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam.
